USER AGREEMENT

Terms and conditions for panel membership

1 GENERAL

1.1 These terms and conditions regulate the membership in Nepa Panel (below “the Panel”) operated for and by Nepa Sweden AB, organisational number 556671-5826 (below “Panel owner” and ”Panel Administrator”), enabled online surveys.

1.2 The Panel Owner and the Panel Administrator collaborate to provide members of the Panel surveys from different parties who wish to conduct surveys in the panel.

1.3 In order to register as a member in the Panel you have to accept these terms and conditions.

1.4 When you become a member in the Panel you are provided the opportunity to participate in surveys that companies wish to conduct.

1.5 As a member in the Panel you are made available to contact by companies who – on behalf of themselves or other Companies – wish to conduct surveys. You can choose to not accept invitations to participate in surveys. You are provided incentive for your participation in surveys according to the terms and conditions of each survey.

1.6 You need to be a resident of the country which the panel is primarily focused on.

1.7 You are only allowed to have one membership in the Panel and for the cases where the Panel Owner or the Panel Administrator discovers multiple memberships for the same person the Panel Owner or the Panel Administrator has the right to unregister all or the surplus accounts. More members in one family has the right to participate in the Panel but surveys can only be answered by own member on the same computer unless other rules are stipulated in the survey.

1.8 The Panel Owner or the Panel Administrator reserves the right to end memberships if the member has not participated in any surveys under a coherent period of time of 36 months, if the member does not fulfil the current requirements for a membership in the Panel or if the member according to the Panel Owner or Panel Administrator has not followed the applicable terms and conditions for a membership in the Panel according to the terms and conditions applicable at any time.

2 INCENTIVE FOR PARTICIPATION IN SURVEYS

2.1 Member is informed before each survey how long time the survey is estimated to take and how much incentive the survey offers. Each member can obtain a maximum of € 99 each year where a maximum of € 9 can be paid each month. The member is solely responsible for paying any potential taxes. The member commits to answer truthfully and carefully to the questions in those surveys the member participates in as well as to always provide correct details about the member’s age and gender or any other requested background variable. If the Panel Owner or the Panel Administrator deem an answer has been provided in contradiction to these terms and conditions the Panel Owner or the Panel Administrator has the right to retain and not provide incentive to the member for the specific survey. After three such incidents the Panel Owner or the Panel Administrator has the right to delete the member’s account. If a member is unregistered from the Panel the member no longer has the right to earned but not yet collected incentive.

2.2 The member owns the right to payment of generated incentive which amounts to or exceeds the minimum amount that at any time is specified on the personal panel account. Incentive is paid to the member in accordance to the pay-out options provided on the Panel’s website. The Panel Owner or the Panel Administrator reserves the right to revise incentive levels, limits for pay-out and incentive options. For some pay-out options a transactional fee may be charged.

3 MEMBERSHIP

3.1 Membership in the Panel is completely optional, and the member has the right to – at any time –end the membership. The Panel Owner or the Panel Administrator has the right to end the membership – at any time – according to 2.1 above.

3.2 If the member terminates its membership in the panel the member no longer has the right to earned but not yet paid out incentive.

4 HANDLING OF PERSONAL DATA

4.1 When you register as a member in the Panel and for the duration of the entire membership the Panel Owner and the Panel Administrator will handle personal data about you. The handling will be congruent with the Panel Owners’ Privacy Policy.
Your personal data will be processed using technology provided by the company Cint AB (“Cint”) which is a Sub processor and as such will be able to access your personal data.

5 CHANGE OF TERMS AND CONDITIONS

5.1 These terms and conditions are applicable in the form they are – at any time – are published on the Panel Owner’s website. The Panel Owner has the right to – at any time – change the terms and conditions for membership in the Panel, these terms and conditions or how surveys are provided.

5.2 If these terms and conditions are changed the changes will be published on the Panel Owner’s website where, at any time applicable terms and conditions are published. Changes to the terms and conditions of the membership in the Panel come into account at the earliest 30 days after the Panel Owner has informed about the changes through email send out to the member’s registered email address. If the terms and conditions are changed the Panel Owner will inform about the changes, when they will come into action and the reasons behind the changes. A member who does not accept the changed terms and conditions may end their membership with immediate effect.

5.3 Beyond what follows mandatory legislation, the Panel Owner or the Panel Administrator is not responsible for potential losses (including lost benefits or worse benefits) as a consequence of these changed terms and conditions nor is the Panel Owner or Panel Administrator responsible for compensation of such losses to the member or any third party.

6 OTHER

6.1 Membership in the Panel does not give the member the right to participate in a certain number of surveys. The Panel Owner and the Panel Administrator’s responsibility is according to these terms and conditions limited to direct damaged affecting the member and shall under no circumstances exceed the average annual incentive paid out to the particular member during the last three years.

6.2 The member grants the Panel Owner an unlimited and free right to forever use any material such as texts and images that the member registers in surveys comprising the right to produce copies, make available to the public and change and transfer material.

6.3 The Panel Owner has the right to transfer all rights according to this agreement to third party.

6.4 Any disputes regarding the membership in the panel that cannot be solved through agreement between the parties shall be settled according to English law by English court.
